1. Introduction

1.1. The webuysell.co.za website, www.webuysell.co.za, is owned and made available by WEBUYCOZA (Pty) Ltd t/a Webuysell.co.za (Registration Number: 2023/847875/07). Any reference to “Webuysell.co.za”, “we”, “our”, or “us” includes our employees, officers, directors, representatives, agents, shareholders, affiliates, subsidiaries, holding companies, related entities, advisers, sub-contractors, service providers, and suppliers.

2. Terminology

2.1. Definitions:

“Vehicle”: The vehicle(s) listed by the Seller on the Website.
“Seller”: A person, Dealer, or Group listing a Vehicle on the Website.
“Purchaser”: A person, dealer, or group purchasing a specific Vehicle.
“Purchase Price”: The highest Offer for a Vehicle at the expiry of the offer period.
“Sale Agreement”: The agreement between the Seller and the Purchaser.
“Advertise my car”: An advertisement placed on the Website related to the sale of a vehicle.
“Sell my car”: Receiving an offer/price for a vehicle through the Website.
“Services”: Services provided to Users through the Website.

3. Costs & Payment

3.1. Webuysell.co.za reserves the right to charge Sellers, Purchasers, and/or Users for using the Services.
3.2. Payment methods include electronic funds transfer (EFT), debit order, or credit card payment via a third-party payment service provider.
3.3. Upon successful payment, the Seller’s Advertisement will be visible on the Website.
3.4. Advertisements will be placed on the website within 72 work hours after successful payment.

4. Services

4.1. Service Offerings:

“Browse cars”: A list of for-sale vehicles from new to used for Users’ convenience.
“Advertise my car”: Sellers/dealers can place advertisements for vehicles on the Website after finalizing costs & payment.
“Sell my car”: Sellers/dealers can list vehicles on the website for potential buyers/dealers to make offers.

5. General

5.1. Webuysell.co.za solely introduces Purchasers to Sellers. Users are responsible for formulating terms related to a vehicle sale.
5.2. Webuysell.co.za acts as a facilitator and is not a party to communications or terms between Seller and Buyer.
5.3. Webuysell.co.za is not involved in vehicle sales, outcomes, or holding deposits.
5.4. Webuysell.co.za is not responsible for the asking price; this term is between the buyer and the seller.
5.5. Webuysell.co.za shall not be liable for indirect, punitive, or consequential losses related to service interruption or otherwise.
5.6. Content on listings is provided by the seller/advertiser, not by Webuysell.co.za.
5.7. The Seller/advertiser shall not upload unlawful, abusive, defamatory, or misleading content on the Website.
5.8. Webuysell.co.za may disable or refuse advertisements that contain false or misleading information.
5.9. Webuysell.co.za makes reasonable efforts to prevent click fraud; no claims against Webuysell.co.za for any click fraud.
5.10. The Website is provided “as is” and used at the User’s risk.
5.11. Users are responsible for compliance with laws, rules, regulations, and taxation obligations.
5.12. Users must notify Webuysell.co.za of any suspected or actual breaches of obligations.
